Public Interest Litigation and the Public Sphere
A controversial study on judicial activism and civil society in India is finally available again – and accessible on our website.
Hans Dembowski’s book „Taking the State to Court – Public Interest Litigation and the Public Sphere“ was originally published in early 2001. However, Oxford University Press soon discontinued international distribution, because the Calcutta High Court accepted a contempt of court petition against the author and the publisher. The OUP management apologised to the High Court, and the case has been kept pending since. No judgement was passed.
We do not intend to scandalise the High Court or the Indian judiciary as a whole. But we do believe that public – and in particular, academic – debate on the judiciary must not be thwarted. Moreover, Dembowski’s book also deals with several other politically relevant issues, such as urban planning, governance and environmental affairs. Therefore we have decided to make the entire book accessible again in a pdf-version.
